Race, Equity and Justice: Ethical and Legal Considerations for how the Legal System Responds to Protestors. These are lofty words and likely words that have been used in the past only to come up short in real world situations. I’m teaching this Minnesota State Bar Association Continuing Legal Education program along with World Class Minnesota Lawyer Willow Najjar Anderson on November 5th in Minneapolis.
People are in the streets across the country and rightfully so. This is certainly the case in Minneapolis and St. Paul in light of the death of George Floyd just a few short months ago. It is extraordinarily challenging when some want this issue to be black and white when there is so much grey in the world and in courtrooms. Further, there are times when clients have no interest in negotiating resolutions or even avoiding convictions. Sometimes, that is exactly the point. At the same time, there are ethical obligations that every lawyer should keep in mind when stepping into this pool.
